Atlas Terms of Service
Welcome to Atlas. These Terms of Service ("Terms") are a legal agreement between you and Atlas Live LLC, a Texas limited liability company ("Atlas," "we," "us," or "our"), governing your use of the Atlas mobile application and website (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which explains how we handle your information. If you do not agree, do not use the Service.

1. Who Can Use Atlas
You must be at least 18 years old to use the Service. By using Atlas, you represent that you are 18 or older, that you have the legal capacity to enter into these Terms, and that you have not previously been suspended or removed from the Service.
2. Your Account
You sign up for Atlas using your phone number, which we verify with a one-time SMS code. You agree to:
- Provide accurate information and keep it up to date;
- Use only a phone number you own or are authorized to use;
- Keep your account secure and not share access with others;
- Notify us promptly at atlaslivehtx@gmail.com if you suspect unauthorized use of your account.
You are responsible for all activity that occurs under your account. Each person may maintain only one account. You can delete your account at any time from within the app.
3. The Service
Atlas helps you discover live music: a real-time map of venues and events, check-ins, venue scrapbooks, and an XP and levels system that reflects your activity.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use, subject to these Terms.
We are always improving Atlas. Features may change, be added, or be removed at any time, and we may suspend or discontinue any part of the Service. Where practical, we will give you notice of material changes, but we are not liable for any modification, suspension, or discontinuation of the Service.
4. Venue and Event Information
Atlas displays information about venues, events, artists, and showtimes gathered from various sources. We do our best to keep this information accurate and current, but we do not guarantee it. Events get canceled, showtimes change, and venues close. Always confirm details with the venue or event organizer before making plans. Atlas is not affiliated with, endorsed by, or responsible for any venue, artist, or event unless we expressly say otherwise.
Atlas does not sell tickets, host events, or operate venues. Your attendance at any venue or event is at your own discretion and risk, and any transaction you make with a venue, artist, or third party is solely between you and them.
5. Your Content
Atlas lets you create content — check-ins, scrapbook photos and notes, profile information, and anything else you post or upload ("Your Content").
You own Your Content. We do not claim ownership of it. However, so that we can operate the Service (store your photos, display your check-ins, show your profile to other users), you grant Atlas a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute Your Content solely for the purpose of operating, providing, and improving the Service. This license ends when you delete Your Content or your account, except (a) to the extent Your Content has been shared with others as part of the Service and they have retained it, (b) for limited periods in routine backups, and (c) where retention is required by law.
You represent that you have all rights necessary to post Your Content and that it does not violate anyone else's rights, including privacy, publicity, and intellectual property rights. If you appear in or photograph other people for your scrapbook, you are responsible for having their permission where required.
We may remove or restrict access to any of Your Content at our discretion, including content we reasonably believe violates these Terms.
6. Acceptable Use
You agree not to:
- Use the Service if you are under 18;
- Post content that is unlawful, defamatory, harassing, threatening, hateful, obscene, or that exploits or endangers minors;
- Check in falsely, manipulate check-in counts, or artificially inflate XP, levels, or streaks, whether manually or through automation;
- Impersonate any person or entity, or misrepresent your affiliation with any venue, artist, or organization;
- Use the Service to stalk, harass, or track any person, or to collect other users' information;
- Scrape, crawl, or harvest data from the Service, or access it by any automated means, without our prior written permission;
- Reverse engineer, decompile, or attempt to extract the source code of the Service;
- Interfere with or disrupt the Service, its servers, or its security features, or circumvent any access controls or rate limits;
- Use the Service for any commercial purpose (including advertising or promotion) without our prior written permission;
- Violate any applicable law or regulation in connection with your use of the Service.
We may investigate violations and take any action we deem appropriate, including removing content, suspending or terminating accounts, and reporting to law enforcement.
7. XP, Levels, and Virtual Items
XP, levels, streaks, badges, and any similar features are virtual features of the Service with no monetary value. They cannot be sold, transferred, exchanged, or redeemed for money or anything of value. We may adjust, reset, or discontinue these features at any time — including correcting XP or levels obtained through manipulation or error — without liability to you.
8. Safety and Assumption of Risk
Atlas is a discovery tool for real-world nightlife. You are solely responsible for your safety and conduct when attending venues and events. Live music environments can involve crowds, loud sound, alcohol service, and late hours. Exercise good judgment: know your limits, comply with venue rules and applicable laws (including those governing alcohol), and never use the app while driving. Atlas does not screen venues, events, or other users, and we are not responsible for the acts or omissions of any venue, artist, event organizer, or user, whether online or offline.
9. Intellectual Property
The Service — including its software, design, logos, name, map presentation, and all content we create — is owned by Atlas Live LLC or its licensors and is protected by intellectual property laws. Except for the limited license in Section 3, no rights in the Service are granted to you. You may not use the Atlas name or logos without our prior written permission.
If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation — though we appreciate them, and you are never obligated to send any.
Copyright complaints. If you believe content on the Service infringes your copyright, send a notice to atlaslivehtx@gmail.com that complies with the Digital Millennium Copyright Act (17 U.S.C. § 512), including identification of the work, the location of the allegedly infringing material, your contact information, the required good-faith and accuracy statements, and your physical or electronic signature. We will respond to valid notices, and we may terminate the accounts of repeat infringers.
10. Third-Party Services
The Service relies on third-party providers (such as Supabase, Twilio, Expo, and Apple) and may contain links to third-party websites or services, including venue and ticketing sites. We do not control and are not responsible for third-party services, and your use of them is governed by their own terms and policies.
If you download the app through the Apple App Store, you acknowledge that these Terms are between you and Atlas Live LLC only — not Apple — and that Apple has no obligation to provide support or maintenance for the Service. Apple is a third-party beneficiary of these Terms and may enforce them against you.
11. Termination
You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or to protect the Service or its users. Upon termination, your license to use the Service ends and Sections 5 (license survival terms), 9, and 12–16 survive.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT VENUE OR EVENT INFORMATION WILL BE ACCURATE, COMPLETE, OR CURRENT. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLAS LIVE LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES ANY DAMAGES ARISING FROM YOUR ATTENDANCE AT ANY VENUE OR EVENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
14. Indemnification
You agree to indemnify and hold harmless Atlas Live LLC and its members, managers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) Your Content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
Informal resolution first. Before filing any claim, you agree to contact us at atlaslivehtx@gmail.com and give us 30 days to work with you to resolve the dispute informally. Most issues can be resolved this way.
If a dispute cannot be resolved informally, it shall be resolved exclusively in the state or federal courts located in Harris County, Texas, and you and Atlas each consent to personal jurisdiction and venue there. You and Atlas each waive any right to a jury trial and agree that any proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.
Nothing in this section prevents either party from bringing a qualifying claim in small claims court or from seeking injunctive relief for infringement or misuse of intellectual property.
16. General Terms
- Changes to these Terms. We may update these Terms from time to time. If we make material changes, we will notify you through the app or by other reasonable means before the changes take effect and update the effective date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Atlas regarding the Service.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
